Holoframe™ is a brand operated by Spark Stack Inc. (“Spark Stack,” “Holoframe,” “we,” “us,” or “our”).

Spark Stack Inc. is the business responsible for Holoframe™, Theholoframe.com, Holoframe™ products, customer orders, payments, fulfillment, customer support, returns, refunds, and the processing of customer-submitted content.

These Terms of Service (“Terms”) govern your access to and use of Theholoframe.com, our product-customization tools, product previews, ordering experience, and any related products or services we provide (collectively, the “Services”).

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer and sell our products and Services.

By visiting Theholoframe.com, uploading content, creating a product preview, placing an order, or otherwise using our Services, you agree to these Terms as well as any policies incorporated into them, including our Privacy Policy and Return & Refund Policy.

If you do not agree to these Terms, you may not use the Services.

We may update these Terms from time to time. The version posted on Theholoframe.com at the time of your use will govern your use of the Services, except where otherwise required by applicable law.

SECTION 1 — ELIGIBILITY AND ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have obtained any legally required consent to use the Services.

You may not use our Services or products for any illegal or unauthorized purpose.

You may not use the Services in violation of any applicable law, including copyright, trademark, privacy, publicity, intellectual-property, consumer-protection, or other applicable laws.

You may not transmit viruses, malware, malicious code, or other technology intended to disrupt, damage, or interfere with the Services.

We reserve the right to refuse, suspend, or terminate access to the Services where reasonably necessary to protect Spark Stack Inc., our customers, our service providers, or third parties.

SECTION 2 — HOLOFRAME™ PERSONALIZED PRODUCTS

Holoframe™ products are customized products created using images, photographs, artwork, selections, instructions, and other content submitted by customers.

Because each product is personalized, the final physical product will naturally vary depending on:

  • The image you submit

  • Image quality and resolution

  • Lighting and exposure

  • Subject placement

  • Cropping

  • Aspect ratio

  • Image processing

  • Layer generation

  • Printing

  • Material characteristics

  • Manufacturing tolerances

  • Lighting conditions in which the finished Holoframe™ is viewed

These normal variations do not necessarily mean that a product is defective.

Nothing in this section limits any rights you may have under our 90-Day Money-Back Guarantee or applicable law.

SECTION 3 — PRODUCT PREVIEWS

Holoframe™ may provide digital, 3D, rendered, simulated, or otherwise computer-generated previews showing how your finished product is expected to appear.

These previews are designed to help you visualize your Holoframe™, but they are not a perfect representation of the physical finished product.

Differences may occur because of:

  • Screen brightness and color settings

  • Digital rendering

  • Image processing

  • Printing processes

  • Physical depth and spacing

  • Acrylic or other material characteristics

  • Lighting and viewing angle

  • Manufacturing tolerances

By approving or ordering a product based on a preview, you acknowledge that reasonable differences may exist between the preview and the finished physical product.

Our 90-Day Money-Back Guarantee continues to apply according to our Return & Refund Policy.

SECTION 4 — CUSTOMER CONTENT

“Customer Content” means photographs, images, artwork, graphics, text, designs, instructions, likenesses, and other content that you upload, submit, send, or otherwise provide to us in connection with Holoframe™.

You retain any ownership rights that you have in your original Customer Content.

Submitting Customer Content does not transfer ownership of that original content to Spark Stack Inc.

However, you grant us certain permissions necessary to create your product, operate our Services, and, as described below, market Holoframe™.

SECTION 5 — LICENSE TO PROCESS AND CREATE YOUR HOLOFRAME™

By uploading or submitting Customer Content, you grant Spark Stack Inc. a non-exclusive, worldwide, royalty-free license to:

  • Upload

  • Host

  • Store

  • Copy

  • Reproduce

  • Crop

  • Resize

  • Format

  • Enhance

  • Segment

  • Separate into layers

  • Modify

  • Process

  • Render

  • Print

  • Manufacture

  • Display

  • Transmit

  • Otherwise use

your Customer Content as reasonably necessary to provide the Holoframe™ Services and create, manufacture, fulfill, support, replace, or refund your personalized product.

This may include processing Customer Content using automated image-processing, computer-vision, artificial-intelligence, or similar technologies used as part of the Holoframe™ creation process.

We may also permit service providers working on our behalf to process Customer Content where reasonably necessary to provide these Services.

Our collection, storage, retention, and deletion of Customer Content is further described in our Privacy Policy.

SECTION 6 — CUSTOMER CONTENT AND MARKETING LICENSE

You retain ownership of your original Customer Content.

However, by uploading or submitting Customer Content and agreeing to these Terms, you also grant Spark Stack Inc. a non-exclusive, worldwide, royalty-free license to photograph, reproduce, crop, resize, format, edit, display, publish, distribute, and otherwise use:

  • Your completed Holoframe™

  • Photographs or videos of your completed Holoframe™

  • Your Holoframe™ digital or 3D preview

  • Customer Content incorporated into your Holoframe™

  • Images or videos showing the finished customized product

for Holoframe™ and Spark Stack Inc. marketing, advertising, promotional, and commercial purposes, subject to applicable law.

This may include use on:

  • Holoframe™ social media accounts

  • Spark Stack Inc. social media accounts

  • Theholoframe.com

  • Other websites operated by Spark Stack Inc.

  • Instagram

  • TikTok

  • Facebook

  • YouTube

  • Pinterest

  • Digital advertisements

  • Social-media advertisements

  • Email marketing

  • SMS marketing

  • Product pages

  • Landing pages

  • Promotional videos

  • Product demonstrations

  • Printed promotional materials

  • Trade shows

  • Public relations materials

  • Other marketing relating to Holoframe™ or Spark Stack Inc.

You authorize us to make reasonable edits necessary for these purposes, including cropping, resizing, formatting, adding branding, adjusting presentation, and combining images or video with other marketing material.

This license does not transfer ownership of your original Customer Content to Spark Stack Inc.

Spark Stack Inc. may allow advertising platforms, marketing agencies, contractors, service providers, or other vendors acting on our behalf to use the applicable content solely as reasonably necessary to provide advertising, publishing, design, or marketing services to us.

Spark Stack Inc. is not required to use any Customer Content for promotional purposes.

Nothing in this section authorizes Spark Stack Inc. to falsely represent that an identifiable person personally endorses Holoframe™ or Spark Stack Inc.

SECTION 7 — YOUR RIGHTS TO SUBMITTED CONTENT

By submitting Customer Content, you represent and warrant that:

  • You own the Customer Content or have sufficient rights and authority to submit it;

  • You have the right to grant Spark Stack Inc. the licenses and permissions described in these Terms;

  • Our permitted use of the Customer Content will not violate another person's copyright, trademark, privacy, publicity, personality, intellectual-property, or other legal rights;

  • You have obtained any permissions reasonably necessary from identifiable individuals appearing in the Customer Content;

  • You are not submitting content that you are prohibited from reproducing or using; and

  • If an identifiable minor appears in Customer Content and parental or guardian authorization is legally required, you are the minor's parent or legal guardian or have obtained appropriate authorization from the minor's parent or legal guardian.

You are responsible for the Customer Content you submit and for ensuring that you have the legal right to submit it.

SECTION 8 — CONTENT WE MAY REFUSE

We reserve the right to reject, remove, or decline to produce a Holoframe™ using Customer Content that we reasonably believe:

  • Violates applicable law;

  • Infringes intellectual-property rights;

  • Violates privacy or publicity rights;

  • Contains unlawful sexual content;

  • Contains sexual or exploitative content involving minors;

  • Promotes serious illegal activity;

  • Contains threats or targeted harassment;

  • Contains malicious files or code;

  • Is otherwise unlawful to reproduce or manufacture; or

  • Could reasonably expose Spark Stack Inc. or our service providers to legal liability.

If we cancel an order because we cannot lawfully or reasonably manufacture it, we may refund amounts paid for the affected product.

SECTION 9 — CUSTOMER IMAGE PRIVACY

Customer images submitted to create a Holoframe™ are handled according to our Privacy Policy.

Customer-uploaded images are not automatically public merely because they are uploaded through our product-creation process.

We do not sell customer-uploaded photographs to data brokers.

We do not use customer-uploaded photographs to create biometric identifiers or for facial-recognition identification.

We do not use customer-uploaded photographs to train public artificial-intelligence models.

Images used solely for product creation and fulfillment are deleted from our active production systems when they are no longer reasonably necessary for those purposes, subject to the additional retention practices described in our Privacy Policy.

Copies lawfully retained or selected for purposes authorized under these Terms, including marketing uses described in Section 6, may be retained as reasonably necessary for those purposes.

SECTION 10 — ORDERS

Submitting an order constitutes an offer to purchase a product from Spark Stack Inc.

We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary.

Reasons may include:

  • Suspected fraud

  • Payment problems

  • Pricing errors

  • Product availability

  • Technical errors

  • Customer Content we cannot produce

  • Suspected unauthorized resale

  • Violation of these Terms

  • Legal or regulatory requirements

An order confirmation does not necessarily mean that an order has entered production.

If we cancel an order after receiving payment and before fulfilling it, we will provide an appropriate refund for the canceled portion of the order.

SECTION 11 — ORDER CHANGES AND CANCELLATIONS

Because Holoframe™ products are custom-made, production may begin shortly after an order is submitted.

If you need to change or cancel an order, contact:

as quickly as possible.

We cannot guarantee that changes or cancellations can be made after production has started.

If we are unable to modify an order because it has already entered production, your rights under our Return & Refund Policy and applicable law are unaffected.

SECTION 12 — PRICING AND PAYMENT

All prices are displayed in the currency indicated at checkout.

Prices, promotions, product configurations, discounts, and availability may change at any time before an order is placed.

You agree to provide current, complete, and accurate billing and account information.

Payment processing may be provided by Shopify or third-party payment processors.

We generally do not directly store complete payment-card information handled by those payment processors.

Applicable taxes, shipping charges, duties, or other charges will be displayed where required or otherwise governed by applicable law.

SECTION 13 — PROMOTIONS AND DISCOUNTS

From time to time, we may offer:

  • Discount codes

  • Promotional pricing

  • Free products

  • Bundles

  • Buy-one-get-one offers

  • Limited-time promotions

  • Giveaways

  • Other incentives

Promotions may be subject to additional terms.

Unless expressly stated otherwise, promotional offers:

  • May not be combined;

  • May expire;

  • May be limited by customer or order;

  • Have no cash value; and

  • May be changed or discontinued where permitted by law.

We reserve the right to cancel orders involving misuse, manipulation, or abuse of promotional offers.

SECTION 14 — SHIPPING AND DELIVERY

Shipping and delivery estimates are estimates only unless we expressly state otherwise.

Delivery times may be affected by:

  • Production time

  • Carrier delays

  • Weather

  • Holidays

  • Incorrect addresses

  • Customs

  • Events outside our reasonable control

Risk of loss and legal title to products will transfer as provided by applicable law and the shipping terms applicable to your transaction.

You are responsible for providing an accurate shipping address.

If you discover an address error, contact support@theholoframe.com immediately.

We cannot guarantee address changes after an order has been processed or shipped.

SECTION 15 — 90-DAY MONEY-BACK GUARANTEE

Holoframe™ products are covered by our 90-Day Money-Back Guarantee as described in our Return & Refund Policy.

If you are not satisfied with your Holoframe™, you may contact us within 90 days after delivery to request a refund pursuant to that policy.

Additional procedures, including whether a product must be returned, are described in our Return & Refund Policy.

Nothing in these Terms limits consumer rights that cannot legally be waived or restricted.

SECTION 16 — DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

If your order arrives damaged, defective, or incorrect, contact:

as soon as reasonably possible.

We may request:

  • Your order number

  • Photographs

  • Videos

  • Packaging information

  • Other information reasonably necessary to evaluate the issue

Depending on the circumstances, we may offer a replacement, refund, reproduction, or other appropriate remedy.

SECTION 17 — INTELLECTUAL PROPERTY

Except for Customer Content owned by customers or third parties, the Services and materials made available by Spark Stack Inc. are owned by or licensed to Spark Stack Inc.

This includes, where applicable:

  • Holoframe™ branding

  • Spark Stack branding

  • Logos

  • Product designs

  • Website designs

  • Graphics

  • Photography

  • Videos

  • Copy

  • Software

  • Product-generation technology

  • User interfaces

  • Product previews

  • Manufacturing methods

  • Templates

  • Marketing materials

You may not reproduce, copy, sell, license, distribute, reverse engineer, commercially exploit, or otherwise use our intellectual property except as permitted by law or with our written authorization.

Holoframe™ is a brand of Spark Stack Inc.

SECTION 18 — REVIEWS, FEEDBACK, AND OTHER SUBMISSIONS

If you voluntarily provide us with reviews, feedback, ideas, suggestions, comments, testimonials, or other submissions relating to Holoframe™, you grant Spark Stack Inc. a non-exclusive, worldwide, royalty-free license to reproduce, publish, display, edit, distribute, and otherwise use that submission for legitimate business and promotional purposes.

You represent that you have the right to provide such submissions.

You may not submit content that is unlawful, defamatory, intentionally false, malicious, infringing, or otherwise violates another person's rights.

We are not obligated to compensate you for unsolicited ideas, feedback, or suggestions unless we separately agree otherwise.

SECTION 19 — THIRD-PARTY SERVICES

Our Services may rely on or integrate with third-party providers, including:

  • Shopify

  • Payment processors

  • Shipping providers

  • Analytics services

  • Cloud hosting providers

  • File-storage providers

  • Image-processing providers

  • Marketing platforms

  • Advertising platforms

  • Email and SMS providers

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for third-party websites, products, or services outside of our reasonable control.

Links to third-party websites do not constitute an endorsement unless expressly stated otherwise.

SECTION 20 — PRIVACY

Our collection and use of personal information is governed by the Holoframe™ Privacy Policy available on Theholoframe.com.

The Privacy Policy includes additional information concerning:

  • Customer-uploaded images

  • Image processing

  • Image deletion

  • Order information

  • Cookies

  • Analytics

  • Advertising

  • Marketing

  • Service providers

  • Privacy rights

SECTION 21 — MARKETING COMMUNICATIONS

Where you provide appropriate consent, we may send marketing communications by email, SMS, or other permitted channels.

Consent to receive promotional SMS messages is not a condition of purchasing a Holoframe™.

Message and data rates may apply.

You may unsubscribe from marketing emails using the unsubscribe link included in those communications.

You may opt out of promotional SMS messages by replying STOP, where applicable.

Even after opting out of promotional communications, we may continue to send transactional or service-related communications concerning your orders, payments, shipping, refunds, customer-support requests, or other interactions with us.

SECTION 22 — PROHIBITED USES

You may not use the Services:

  • For unlawful purposes;

  • To violate applicable laws or regulations;

  • To infringe intellectual-property rights;

  • To violate another person's privacy or publicity rights;

  • To harass, threaten, exploit, or harm another person;

  • To submit deliberately false or misleading information;

  • To transmit malware or malicious code;

  • To interfere with the security or functionality of the Services;

  • To scrape or automatically collect information from the Services without authorization;

  • To circumvent security measures;

  • To impersonate another person;

  • To commit fraud;

  • To interfere with another customer's use of the Services; or

  • For any other activity that exposes Spark Stack Inc. or others to unlawful conduct.

We may suspend or terminate access for violations of this section.

SECTION 23 — ACCURACY OF INFORMATION

We make reasonable efforts to provide accurate product descriptions, prices, photographs, shipping information, and other information.

However, errors may occasionally occur.

We reserve the right to correct errors, inaccuracies, or omissions and, where permitted by law, to change or update information or cancel an affected order.

If we cancel an order because of a material pricing or listing error after payment has been collected, we will refund the applicable payment.

SECTION 24 — MODIFICATIONS TO THE SERVICES

We may add, modify, update, suspend, or discontinue portions of the Services from time to time.

This may include changes to:

  • Product designs

  • Product sizes

  • Materials

  • Prices

  • Features

  • Customization tools

  • Preview technology

  • Website functionality

  • Promotions

Changes will not limit rights that have already accrued to you under applicable law.

SECTION 25 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis except for warranties or guarantees expressly provided by Spark Stack Inc.

We do not guarantee that:

  • The website will always operate without interruption;

  • Every digital preview will perfectly match a physical product;

  • Every technical error will be corrected immediately; or

  • Third-party services will always remain available.

This section does not eliminate our 90-Day Money-Back Guarantee or any warranty, remedy, or consumer right that cannot legally be excluded.

SECTION 26 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Spark Stack Inc., together with its directors, officers, employees, affiliates, contractors, suppliers, service providers, and licensors, will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to your use of the Services or products.

This may include, where legally permitted, loss of profits, revenue, data, business opportunities, or similar losses.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Nothing in this section eliminates rights provided by our 90-Day Money-Back Guarantee.

SECTION 27 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Spark Stack Inc., its affiliates, directors, officers, employees, contractors, service providers, suppliers, and agents from third-party claims, liabilities, damages, or reasonable expenses arising from:

  • Customer Content you submit;

  • Your breach of these Terms;

  • Your violation of applicable law;

  • Your infringement of another person's intellectual-property rights;

  • Your violation of another person's privacy or publicity rights; or

  • Your misuse of the Services.

This section does not require indemnification to the extent a claim results from Spark Stack Inc.'s own unlawful conduct.

SECTION 28 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

SECTION 29 — WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only when expressly made by Spark Stack Inc.

SECTION 30 — TERMINATION

These Terms remain effective while you use the Services.

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary because of:

  • A violation of these Terms;

  • Fraud or suspected fraud;

  • Security concerns;

  • Illegal conduct; or

  • Other conduct that could reasonably harm Spark Stack Inc., customers, service providers, or third parties.

Any provisions that by their nature should survive termination will remain in effect, including intellectual-property provisions, Customer Content licenses already exercised, disclaimers, limitations of liability, indemnification obligations, and governing-law provisions.

SECTION 31 — ENTIRE AGREEMENT

These Terms, together with policies incorporated by reference, including our Privacy Policy and Return & Refund Policy, constitute the agreement between you and Spark Stack Inc. concerning your use of the Services.

They supersede prior versions of these Terms relating to the same subject matter.

SECTION 32 — GOVERNING LAW

These Terms and any separate agreements through which Spark Stack Inc. provides Holoframe™ products or Services will be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Nothing in these Terms deprives a consumer of protections that cannot legally be waived under the laws applicable to that consumer.

SECTION 33 — CHANGES TO THESE TERMS

We may update, modify, or replace these Terms from time to time to reflect changes in:

  • Our Services

  • Our products

  • Our business

  • Our technology

  • Our legal obligations

  • Applicable laws or regulations

The updated version will be posted on Theholoframe.com with a revised “Last updated” date.

Where required by law, we will provide additional notice or obtain consent before material changes become effective.
